照護無家者,照護自己:新型態無家議題工作者的實作與反思/黃克先、陳思樺、黃怡菁124112.4 1-49
無家可居是當代城市中難以處理的持存問題。台灣在民主化過程中發展出無家者社會福利體制,挹注更多資源並拓展更廣服務,但仍無法解決該問題,反使無家者陷入習得性無能及再被汙名化的處境。不過,近來無家者在社會被看待及對待的方式有了明顯變化,促此改變的重要力量是一群關注無家者議題之新型態組織的工作者。本文運用照護邏輯的理論概念,以參與觀察與深度訪談的材料,揭示他們如何以嶄新方式服務無家者並促成社會變革。
運用照護邏輯的實作可容許不確定性、非單向線性的工作模式,並納入無家者及其周圍同儕,藉共同作伙修補中提升福祉。無家者在參與過程中被鼓勵發聲,這些故事用以促進社會對話並去除無家者汙名。這種運用照護邏輯的實作對工作者本身也產生了迴向效果,讓他們照護無家者的同時也照護自己。他們在實作中反思自身生命歷程及現前處境,進而改善工作職場及家庭中的關係。由此,這群工作者的照護無家者的實作,不該簡單看待為愛心、耐心的個人道德特質之體現;他們打造出的照護異托邦具備著促成社會變革的基進潛力,對照既有受新自由主義影響的社福實況下,提供我們思考服務無家者中促成社會變革及助人工作者發展的可能性。

Homelessness has been a long-lasting, hardly tackled problem in modern cities. Although a more complete and well-funded social welfare regime for serving the homeless has been gradually developed in democratizing Taiwan, the homeless problem is not solved, and more problems such as learned helplessness and re-stigmatization emerge. However, the perception of homelessness and ways of treating the homeless in Taiwan have changed recently, due to efforts of workers from several new organizations for the homeless as the major forces facilitating such transformation. !is study, based on participant observation and in-depth interviews with these workers, reveals how they provide services to the homeless in the light of Annemarie Mol’s concept, “logic of care”.
As opposed to the traditional linear ways of caring that are worker-dominated,
the working process adopting the logic of care involves both the homeless people themselves and these workers as fellows together in the process of shared doctoring. In the process of shared doctoring, the stories of homeless people are framed as narratives that facilitate social dialogue in public sphere. Meanwhile, through practices of caring for the homeless, these workers also in return develop ways of caring for themselves, reflecting on their own life course and current situations and endeavoring to transform relations in workplaces and families. !at is to say, we should not take these practices of caring by these workers simply as actions out of their individual morality such as love and patience rather than as possibilities of self-development of themselves. In sum, such heterotopia of care these workers construct not only serve as a critique of neoliberalist social welfare system but also may have the radical potential for social transformation.

「你怎麼嫁到比大陸還大陸的地方?」:性別化地緣政治與臺港跨境婚姻/黃宗儀、黃佳媛124112.4 51-96
臺港婚姻在過去二十年間呈現數量穩定成長的現象。雖然兩地經濟發展並無重大差異,但在移居臺灣的香港女性婚姻移民的婚姻歷程中仍常見「上嫁/下嫁」的矛盾:在香港娘家人眼中,她們是從一個有利的地理位置(全球城市香港)搬遷到不利的地理位置(落後的臺灣);臺灣夫家人則將香港與中國類比,認為香港來的也是陸配。本研究以43位透過婚姻移民臺灣的香港女性(簡稱「港妻」)為深度訪談對象,探討臺港社會過去數十年對跨國/跨境婚姻的文化想像,藉此釐清臺港跨境婚姻中父權、國族與資本交織產生的他者化現象。本研究發現,婚姻移民所產生的跨境家戶性別政治,是夫家、娘家以及港妻三方對女性婚姻主體的協商過程,除了涉及港妻個人感受之外,也與臺港跨境婚姻中的姻親對兩岸三地發展的看法息息相關。臺灣夫家與香港娘家分別挪用地緣政治的想像來建構其「上嫁/下嫁」的論述,從而貶抑港妻之婚嫁選擇,由此彰顯女性應恪遵婚前從父、婚後從夫的傳統性別角色。然而,港妻強調對自身婚姻遷移的滿意程度並非侷限於物質層面,而是取決於生活品質、階級品味、民主制度、田園情趣等生活方式型遷移所追求的價值。兩岸三地變動隱微的地緣政治關係,使得臺港婚姻的案例有其獨特性與重要性,促使我們批判性地看待「上嫁/下嫁」的跨國婚姻預設,並深入理解女性婚姻移民與父權家庭協商的複雜性。

The last two decades saw a steady increase in Taiwan-Hong Kong cross-border marriages. While there is no significant gap in terms of economic development between the two places, the marrying-up or marrying-down narrative remains ingrained and associated with Hong Kong female marriage migrants to Taiwan. While their Hong Kong families see the move as a “downgrade” from a favorable geographical location (Hong Kong, a global city) to an unfavorable one (Taiwan, a more “backward” place), their Taiwanese in-laws tend to put them in the same pigeonhole as “mainland spouses”. This study interviews 43 Hong Kong wives to delineate the cultural imagination of cross-border marriages in the two societies in order to look into the process of “othering” that stems from the intersection of patriarchy, nationhood and capital in such marriages. This study identifies the gender politics of these families as a tripartite negotiation--between the husband’s family, the wife’s family and the wife herself--over the marriage migrants’ subjectivity, which is shaped not only by the personal feelings of these Hong Kong wives, but also is closely related to the in-laws’ views on the development of Taiwan, Hong Kong and mainland China. Both Hong Kong parents and their Taiwanese in-laws have created their own marrying-up or marrying-down discourses based on their respective geopolitical imaginations, which entails an implicit assumption of women to obey their fathers before marriage and their husbands after marriage. Contrary to these assumptions, however, these Hong Kong wives often emphasize that life values such as democracy and quality of life--rather than material conditions--are what determine their level of satisfaction with their marriage migration. The subtle shift in geopolitical relations between the three regions across Taiwan Strait have highlighted the importance of the case of Taiwan-Hong Kong marriages, which calls for a critical assessment of the presumption of hypergamy in cross-border marriages and a deeper understanding of the complexity that underlies the dialectics between female marriage migration and patriarchism.

土地徵收的再審視:生活世界的視角/蔡穎杰、徐世榮124112.4 97-158
近年來,若以大埔事件為濫觴,土地徵收所造成的侵害居住權、財產權、生存權之案例不勝枚舉。雖然在2012 年立法院曾修正《土地徵收條例》加強規範土地徵收的要件審查,但土地掠奪的案例依然層出不窮,尤其政府在媒體上習於宣揚土地開發產生的財政收益以及公共利益來正當化土地徵收。本文使用文獻分析法、參與觀察法、焦點團體法,分析土地開發案例法定流程中的權力運作與後果。本文在理論部分以哈伯瑪斯系統與生活世界的理論視角切入輔以葛凡達權力運作模式分析,以各自救會觀點為主體闡明土地徵收各個階段的狀況。本文的結論主張,現行體制缺乏保障民眾實質參與土地使用與土地徵收的規劃,因此導致土地使用與土地徵收的法定程序之中充斥權力操弄,並誤導社會大眾有關土地徵收的定義與資訊。本文最後提出有關土地徵收體制三點建議。

Land expropriation and forced eviction in Taiwan have become increasingly serious social problems in recent years. In order to pursue economic growth, the government proposes many megaprojects and frequently uses its power of land expropriation to seize private land. The government proclaims that these megaprojects can bring great public benefits to society, which is the main justification for land expropriation. However, many farmers and local residents are forced to leave their homes and farmlands as a result. The goal of this research is to explore the process of land expropriation from the perspectives of residents. We use the perspectives of Habermas’s system and lifeworld and John Gaventa’s three dimensions of power to analyze land expropriation in Taiwan. We conclude that due to the authoritarian land use regime, the public may be misinformed about the facts and so-called “public interests” surrounding land expropriation. In general, the government downplays the number of land takings and overestimates the so-called “public interest.” We suggest including local residents in the process of master plans and development projects to prevent human rights violations.
